Using Crabs for bait...legal size...???

So, Overkiller and I were discussing catching some crabs for bait to use this weekend on our quest for a big, big nasty. The question came up: Do they have to be the legal size in order to use them for bait, or can we use smaller ones? The answer seems obvious, but what do you guys think? Thanks

You can use smaller ones legally.

It says "Except that not more than 5% by number of undersized blue crabs may be possessed for bait purposes only and must be placed in a separate container."

I'm guessing that means 5% of total catch since there isn't a daily limit on them.
